Washington State Judge Halts Kalshi Prediction Market Operations

King County Superior Court Judge John McHale has issued a preliminary injunction blocking Kalshi from offering event contracts to Washington residents. The ruling sides with state regulators who argue that the platform’s prediction markets constitute illegal gambling, threatening substantial financial harm to local consumers.

The decision marks another legal setback for the platform, which has faced similar restrictions in Massachusetts, Michigan, Nevada, and New York. While Kalshi maintains that states lack the jurisdiction to regulate these markets—citing the Commodity Futures Trading Commission's authority—courts continue to favor local enforcement of gambling statutes. Kalshi representatives criticized the ruling on Tuesday, labeling the state's legal pursuit a waste of taxpayer resources.

The broader industry faces a persistent tug-of-war between state authorities and federal regulators. Although a federal appeals court previously limited New Jersey’s ability to oversee these contracts, individual states remain aggressive in their opposition. As popularity for wagering on sports and political outcomes surges—most notably following the 2024 U.S. presidential election and the recent soccer World Cup—the legal viability of these platforms remains tethered to these unresolved jurisdictional battles.
