Spain’s Antitrust Regulator Targets Six Major Banks Over Mortgages

Spain’s antitrust watchdog has launched a probe into the country’s six largest listed lenders, investigating whether public comments by executives regarding interest rates on fixed-rate mortgages may have facilitated anti-competitive coordination among competitors in a highly aggressive market.

The National Commission for Markets and Competition (CNMC) is examining whether bank leadership signaled future commercial strategies, effectively allowing rivals to anticipate and adjust their own pricing. This scrutiny follows a period of intense rivalry within the Spanish mortgage sector, where some executives previously characterized ongoing efforts to capture market share as irrational, citing rates that dipped below prevailing market benchmarks.

Data from the European Central Bank highlights the intensity of this competition; as of April, the average mortgage rate in Spain stood at 2.81%, significantly lower than the 3.44% average across the broader euro zone. The investigation encompasses Santander, BBVA, Caixabank, Unicaja, Bankinter, and Sabadell. While all six institutions declined to comment, Alejandra Kindelan, head of the Spanish Banking Association, defended the sector, asserting that the banks operate in accordance with the law and maintain the most competitive mortgage market in Europe. The regulator has set a 24-month window to reach a final decision, noting that the opening of proceedings does not signal a predetermined outcome.
